Legislation relating to that relates to the recording, storage and sharing of information in care settings includes:

  • The Data Protection Act 2018 and General Data Protection Regulations 2021 – set out how personal information is collected, stored and shared
  • The Freedom of Information Act 2000 – a framework for the sharing of information that is stored by the government and local authorities that is in the public interest
  • The Human Rights Act 1998 – establishes freedoms and liberties for all UK citizens
  • The Care Act 2014 – the local authority must make information available about an individual’s care and support

The main pieces of legislation relating to data handling are the Data Protection Act and General Data Protection Regulations. They set out why data can be collected and the regulations that must be complied with for storing and processing information. It is regulated by the Information Commissioners Office.
